The defendants were charged, in the Superior Court of Whitfield County, with murder and were jointly indicted, tried, and convicted of voluntary manslaughter. Briefly, the testimony on the trial was to the effect that the deceased, Bright, had, earlier in the evening and without justification, fired a shotgun into the rear of an automobile in which the defendants were riding, which was a borrowed car. The defendants left the premises, but returned, each armed with a gun; two of the defendants entered by the front door the house where the deceased was visiting and the other entered by the rear door, and asked to see him. The deceased then stepped out from behind a door with a gun in his hand and ordered the defendants to drop their guns. Two of them did so; the third, Herman Ledford, and the deceased, a soldier, exchanged shots from which the soldier died a short time later. The testimony as to the manner of the shooting was in conflict, and will be discussed in greater detail in relation to the special grounds of the motion for new trial. The defendants were convicted of voluntary manslaughter. They filed a motion for new trial on the general grounds, and each motion was amended by adding four identical special grounds. The denial of the motions for new trial as amended is here assigned as error.
